JUDGMENT AND ORDER
This matter having come on for hearing before the Disciplinary Commission of the Supreme Court of Arizona, it having duly rendered its decision, and no timely petition for review having been filed.
IT IS ORDERED that the Court grants sua sponte review.
IT IS FURTHER ORDERED that this Court’s March 28, 2002 Judgment and Order in SB-02-0007-D be amended, nunc pro tunc, as follows:
1. Respondent’s period of suspension from the practice of law is increased to one (1) year, effective from March 28, 2002, for conduct in violation of his duties and obligations as a lawyer, as disclosed in the Disciplinary Commission Report.
2. The provision providing for the imposition of probation while Respondent is suspended is vacated. As a condition of reinstatement. Respondent is now and will hereafter be required to demonstrate compliance in all respects with every term and condition of the Member Assistance Program/Probation Contract signed and executed by him June 17, 2003.
IT IS FURTHER ORDERED Respondent shall comply with all rule provisions regarding reinstatement proceedings.
IT IS FURTHER ORDERED that pursuant to Rule 60(b), the State Bar of Arizona is granted judgment against Respondent for costs and expenses of these proceedings in the amount of $637.75, together with interest at the legal rate from the date of this judgment.
