In the Matter of: EXTENDING THE TIME TO MEET THE REQUIREMENTS OF ARIZONA CODE OF JUDICIAL ADMINISTRATION SECTION 1-302 (L)(7)(a)(5).

Administrative Order No. 2009-22Supreme Court of Arizona.
February 18, 2009.

RUTH V. MCGREGOR, Chief Justice.

Administrative Order No 2009-01 ordered the Administrative Director to: (1) Examine all expenditures and revenue sources available to the court and identify where cuts can be made and/or revenue increased. The Administrative Director has advised that the cancellation of the March Intensive Probation Supervision (IPS) training is an appropriate area where a cut can occur. In order for the cancellation of the March training to occur, it is necessary to waive the requirement for some officers to complete IPS training within twelve months of assignment.

Arizona Code of Judicial Administration (ACJA) Section 1-302
(L)(7)(a)(5) provides:

a. All adult and juvenile probation and surveillance officers shall successfully complete, at minimum:
(5) Successful completion of the Institute for Intensive Probation training within twelve months of assignment for all officers assigned to the intensive probation supervision (IPS) program.

In order to provide all officers the opportunity to meet these requirements, the Administrative Office of the Courts Education Services Division scheduled an IPS training from March 15 to March 20, 2009. The current enrollment for this training is insufficient to warrant conducting the training at this time in view of the cost and the state budget crisis. Cancellation of the March training will mean some IPS officers will not have the opportunity to complete the Intensive Probation training requirement within twelve months of assignment as required. The next opportunity for officers to attend the training required by ACJA Section l-302(L)(7)(a)(5) is the scheduled September 13 to September 18, 2009 training.

Now, therefore, pursuant to Article VI, Section 3, of the Arizona Constitution,

IT IS ORDERED that the period for successful completion of the Institute for Intensive Probation training required by the Arizona Code of Judicial Administration (ACJA) Section 1-302 (L)(7)(a)(5) is extended by six months.
