Pursuant to the provisions of ACJA § 7-1201(H)(12), hearings may be conducted before hearing officers when hearings are requested by applicants denied certification or reinstatement of certification by the Court’s certification and licensing programs or upon the filing of a formal statement of charges against a certificate holder. ACJA § 7-201(H)(14) specifies that the disciplinary clerk, upon request for a hearing from an applicant or a certificate holder shall select a hearing officer from the approved list, to conduct the hearing.

ACJA § 7-201(H)(14) specifies that to be eligible for appointment as a hearing officer an individual shall be admitted to the practice of law in Arizona and an active member in good standing for at least seven years with the State Bar or Arizona; or an active or retired judicial officer. Further, § 7-201(H)(14) specifies the applicant shall have knowledge in the procedure for conducting administrative hearings regarding the denial of initial or renewal of certification or alleged acts of misconduct or violations by a certificate holder. In order to permit the efficient assignment of hearing officers to preside over hearings under ACJA § 7-201, and after due consideration of the qualifications and experience of the applicants,

IT IS ORDERED that the Court approves the appointment of retired Judge Louis A. Araneta and retired Judge Jonathan Schwartz as hearing officers to preside over hearings pursuant to ACJA § 7-201. The appointment of hearing officers Araneta and Schwartz is effective upon entry of this Order and shall continue until the Court determines their services are no longer needed.

IT IS FURTHER ORDERED that hearing officers Araneta and Schwartz shall be compensated for their services at a rate determined by the Administrative Director and in accordance with the approved employee compensation schedule.
